Call them often because they will listen to what their voters have to say.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2026 Legislation<\/h3>\n\n\n\n<p>We are currently monitoring the following bills: <\/p>\n\n\n\n<p><strong>HB4488<\/strong>, Section 1: B. total losses allows storage to be deducted\u00a0M. repair value plus salvage value meets or exceeds ACV N. insurance determines whether or not TL vehicles can be repaired to \u201coperative\u201d condition Section 2: B. RTA<\/p>\n\n\n\n<p><strong>SB1920<\/strong>, increase TL to 70%<\/p>\n\n\n\n<p><strong>HB4143<\/strong>, Section 2: A. all LEO must write a report on all accidents if damage is over $3000 or w\/injury or death w\/in 30 days unless no law called due to private property. (currently the amount is $500)\u00a0<\/p>\n\n\n\n<p><strong>HB3148<\/strong>, Titling of a salvage vehicle<\/p>\n\n\n\n<p><strong>SB1226<\/strong>, 3x value owed if you leave the scene of an accident<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Engage directly with your representatives &#8211; explore <a href=\"http:\/\/www.oklegislature.gov\/FindMyLegislature.aspx\">Find Your Legislator<\/a> and reach out! Your involvement can make a real difference! <strong>Do not wait<\/strong> \u2013 your participation is pivotal. \ud83c\udf1f<\/h2>\n\n\n\n<p><strong>November 2025<\/strong><\/p>\n\n\n\n<p>The Oklahoma Auto Body Association (OKABA) and 13 auto body shops are calling two new laws unconstitutional in separate lawsuits they\u2019ve filed against the state. (A court date has been set for January 2026, more details to come &#8211; <em>UPDATE: Court dates pushed back again to May<\/em>).<\/p>\n\n\n\n<p>Both suits request a temporary injunction and declaratory judgment from a judge, claiming that the laws, which took effect on Nov. 1, are unconstitutional.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/legiscan.com\/OK\/text\/HB1084\/id\/3042995\" rel=\"noreferrer noopener\" target=\"_blank\">House Bill 1084<\/a>, passed by the 2025 legislature, creates a law that bans consumers from assigning benefits to an auto body shop. Read the full suit filed against the law&nbsp;<a href=\"https:\/\/www.repairerdrivennews.com\/wp-content\/uploads\/2025\/10\/Document_10302025142701194_0001-1.pdf\">here<\/a>.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/legiscan.com\/OK\/text\/SB641\/2025\" rel=\"noreferrer noopener\" target=\"_blank\">Senate Bill 641<\/a>, also passed<a href=\"https:\/\/www.repairerdrivennews.com\/2025\/05\/28\/oklahoma-storage-fees-bill-becomes-law-becomes-effective-nov-1\/\">&nbsp;by the 2025 legislature<\/a>, created a law that caps the daily storage fees for total loss vehicles at $39 for gas vehicles and $125 for EVs with a damaged battery. It can be increased to $75 for gas and $200 for EVs on the 11th day.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Read the full suit filed against the law&nbsp;<a href=\"https:\/\/www.repairerdrivennews.com\/wp-content\/uploads\/2025\/10\/Document_10302025142502384_0001.pdf\">here<\/a>.<\/p>\n\n\n\n<p>Peyton Bell, a plaintiff in the case, owns Bell Auto Body and was the verifying signer for the suits.<\/p>\n\n\n\n<p>\u201cWe are finally starting this war of David and Goliath,\u201d Bell said Thursday.&nbsp;<\/p>\n\n\n\n<p>The laws are unconstitutional because they violate the free market clause, Bell said.&nbsp;<\/p>\n\n\n\n<p>If storage rates are capped, insurance companies have no incentive to move total loss vehicles that can sit in review for, at times, up to six or seven months, he said.&nbsp;<\/p>\n\n\n\n<p>During this time, customers are not getting paid, they don\u2019t have a vehicle, and they can\u2019t get a new vehicle, he said. He added that repair shops have real estate tied up during the process as well.&nbsp;<\/p>\n\n\n\n<p>HB1084 and SB641 Effective November 1, 2025 (See links above for details)<\/p>\n\n\n\n<p><strong>May 2025<\/strong><\/p>\n\n\n\n<p>Your OKABA legislation team has been working overtime this legislative session. Regarding SB 641, since last quarter of 2024, our legislative committee has been attempting to negotiate the language to a more fair ruling for shops, insurers and consumers. The current document can be read <a href=\"https:\/\/www.oklegislature.gov\/BillInfo.aspx?Bill=sb641&amp;Session=2500\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>. Although it is not ideal, it it the fairest version we have seen yet. As it is on the Governor&#8217;s desk, we have just a short amount of time to voice our vote. Please <a href=\"https:\/\/www.oklegislature.gov\/FindMyLegislature.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">find your legislator<\/a> and call (email may not be read in time). <\/p>\n\n\n\n<p><strong>January 2025<\/strong><\/p>\n\n\n\n<p>We have received a copy of SB 784 and will be working diligently to stop it. Please tell your legislators to vote NO! Check out the new Rule Change that states:&nbsp;&#8220;insurer shall conduct a market survey of the prices charged for repairs performed in accordance with manufacturing standards by repair facilities within the CBSA the facility performing the repairs is located within or is nearest to.
